I agree to indemnify and hold harmless, the Rockwall Adoption Center (HEREFORWARD REFERED TO AS “RAC”), the CITY OF ROCKWALL (HEREFORWARD REFERED TO AS “CITY”) and their agents, employees, officials, representatives, volunteers, or board members, for any damage and/or injuries to any person, property, or other animals as a direct or indirect result of the adoption and/or receipt of this animal. Further, Adopter indemnifies and releases RAC and CITY from any and all past, present and future liability, claims, rights, damages, debts, costs, causes of action, and demands of any kind whatsoever, whether based in tort, contract, or other theory of recovery, including, but not limited to any claim for personal injuries or loss of services or loss of consortium, which the Adopter or their heirs, administrators, or assigns, ever had, nor have, or may have in the future have, against RAC, CITY and for its employees, officials or volunteers, arising by reason of or in any way related to or connected with, or that may be trace, either directly or indirectly to the adoption of the said animal.(Required)

I am able and willing to spend time and money necessary to provide for the training, medical treatment and proper care for the pet as well as to keep him/her current on heartworm preventive and vaccinations for the entirety of the dog’s life.(Required)

I agree to abide by state, city and county ordinances regarding animal, including and applicable animal licensing with the city he/she will be residing in and the animal will be provided with an ID tag within 24 hours of taking the animal home.(Required)

This is not a Gift Adoption. I understand the RAC will not allow the pet to be adopted by anyone other than myself, the intended owner, as stated on the application and confirmed by signing this contract.(Required)

I hereby agree to care for the above described pet in a humane and responsible manner and to provide him/her with clean and adequate shelter, food, water and veterinary care. When the pet is outdoors, it shall be provided with protection from the elements as defined by a dry, insulated, draft-fee shelter that provides shade from the sun as needed. I agree to abide by any State laws or City ordinances relevant to the safety of the pet during and after the trial period.(Required)

If the dog/puppy I am adopting is not already altered, I understand that all RAC pets are neutered/spayed (“S/N”) on their pre-scheduled appointment dates at RAC. This appointment can only be rescheduled if the pet’s medical emergency is cleared by the vet at RAC. I understand that RAC will not accept letters from vets outside RAC requesting that the S/N appointment is moved.(Required)

If any health related problem(s) occur during the 5 day (45 business hours) trial period, I understand that I may contact RAC for help with such issues. I understand that RAC WILL NOT reimburse for vetting that does not have prior written authorization from the Supervisor at the RAC. I understand that by electing to take my dog/puppy to a vet WITHOUT written authorization, I forfeit my right to have RAC pay for services.(Required)

I understand that RAC does NOT Guarantee the breed, weight, age, temperament and or health of the dog/puppy I am adopting.(Required)

I understand that there is a 5 day trial period (45 business hours). During this time frame, I have the opportunity to make certain that the dog or puppy is right for my family and lifestyle. The 5 day trial (45 business hours) begins the day and time this adoption contract is signed. The trial period expires 45 business hours – excluding Sundays or Holidays when RAC is closed to the public. I understand that I DO NOT become the legal owner of the animal until the completion of the trial period. I understand that the adoption fee is non-refundable at the end of the 5 day (45 business hours) trial period.(Required)

I have the means to contribute an adoption donation to RAC in recognition of the care given to my pet while in the custody of RAC. If the animal I adopted is returned to RAC within the 45 business hours from the date and time this contract/waiver is signed, I may be eligible to receive a full refund for my donation. The adopted animal must be returned to RAC in same condition as the animal was when he/she was adopted, at the time this adoption contract was signed.(Required)

If the pet is returned to RAC after the 5-day (45 business hours) trial period has expired, or with sustained illness or injuries that occurred while in my care, I understand that no refund will be issued. If the dog is returned in need of medical care due to injury/illness that results while the pet is in my care, I understand that I can be held liable for medical costs incurred.(Required)

I understand if I lose (“lose” as defined by the pet being deceased or the adopter unable to secure/locate their pet) an adopted animal prior to the end of the 5-day trial (45 business hours) period, the adoption donation will not be refunded. Furthermore, if the pet has not been altered prior to my losing the pet, I understand that I will be liable for a $1,000 fine payable to RAC within 30 days of the time the loss occurred.(Required)

Unless prior arrangements are made in writing with RAC staff, I understand that the last day and time to return the pet to receive a refund of the adoption fee, is 45 business hours from the sent/received time stamp on this finalized contractual agreement(Required)

I understand that if I return the pet within the 5-day (45 business hours) trial period, I will receive the refund once all medical records, tags, medication and any purchased heartworm prevention is received. Fees for lost vet records are as follows: Rabies tag $5 and microchip tag $10.(Required)

If I am pre-adopting a pet, the 5 day (45 business hours) trial period begins the date the adoption contract is signed and will expire in 45 business hours, regardless whether the animal is available to go home yet.(Required)

Failure to adhere to the contract can and will subject you to lawsuit for breach of contract and liquidated damages of $1000.00 plus court costs and I will return the dog to RAC custody within 24 hours of written notice from RAC. Although RAC does not wish to file suit, for the sake of the dog, we will prosecute if this contract is not followed. We appreciate your cooperation and understanding in this matter.
